Legal Control of Property

The legal check is carried out by a lawyer and is crucial to avoid legal obstacles to the possession of the property. The lawyer must consider:

  1. Legal status of the property: Checks the property’s documents at the competent Land Registry or Land Registry Office to determine whether there are any mortgages, mortgages, claims or other legal pending issues.

  2. Repayment of previous purchase price: confirms that the price of the current or previous purchase has been paid in full.

  3. Legitimacy of titles: examines in detail the titles of the property and the ways in which it was acquired by the owner or previous owners, ensuring the legality of ownership.

Technical Property Control

It is recommended that a civil engineer or architect be commissioned to carry out the technical inspection. Although it is not mandatory, it may prove necessary to ensure the quality of the property. The technical inspection includes:

  1. Construction Quality: Examination for any construction or structural problems that could affect the safety or value of the property.

  2. Planning Compliances: Checking for possible overbearing or arbitrary areas of the property, ensuring that the property complies with planning regulations.

  3. Building plot control: In the case of a plot of land, the technical specialist assesses the buildability and any ownership obligations.

  4. Building Permit Control: Visits the relevant Planning Department to check if there are any arbitrary acts, planning violations or encroachments that may affect the legality of the property.
The combination of the above checks offers a comprehensive picture of the legal and technical status of the property, facilitating the purchase without any future legal or technical surprises.
